Claims Trading and Receivables Default Protection

Esbin & Alter has over two decades of substantial experience in the ever expanding claims trading market. We have represented buyers, sellers and brokers in connection with thousands of transactions involving billions of dollars of claims, including secured, general unsecured, administrative and priority claims under the US Bankruptcy Code, claims arising in various foreign bankruptcy proceedings, claims against non-bankrupt domestic and foreign companies, and claims arising from various swap and derivative-based financial contracts. As such, we regularly advise clients in transactions involving claims arising in jurisdictions around the world, including jurisdictions throughout the Americas, Europe, Asia and Australia. Additionally, our substantial corporate bankruptcy and insolvency knowledge allows us to provide our clients with critical pre-trading and post-closing strategies, as well as documenting specific claim transfers in various jurisdictions.

We have also applied our extensive experience in the claims trading marketplace in representing clients in numerous financing transactions involving their purchase and/or sale of credit default protection of accounts receivable exposure to stressed and distressed companies. In that regard, we have negotiated, documented and implemented, on behalf of our clients, various master claims default protection agreements and all related documentation.
